Terms of Service

Please read these terms carefully before using the services of JBS Securities Pvt Ltd. By accessing our website or trading platforms, you agree to be bound by these terms.

JBS Securities Pvt Ltd (SEBI Registration No: INZ000191134, CIN: U67120GJ1995PTC026550) is a SEBI registered stock broker incorporated in 1995, and a corporate member of the National Stock Exchange (NSE), member of BSE and MSEI, with CDSL depository services (DP Registration: IN-DP-250-2016).

These Terms and Conditions govern your use of our website, trading platforms (desktop, web and mobile), depository services, and all related services. By opening an account with us or using any of our services, you agree to comply with and be bound by these terms along with our Privacy Policy.

Acceptance of Terms

By accessing, browsing or using the website, trading platforms, or any services provided by JBS Securities Pvt Ltd, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you (“Client”, “User”, “you”) and JBS Securities Pvt Ltd (“Company”, “we”, “us”, “our”).

Eligibility & Account Opening

To use our trading and investment services, you must:

  • Be at least 18 years of age and legally competent to enter into a contract under Indian law
  • Complete the KYC (Know Your Customer) process as mandated by SEBI and provide valid identity and address proof
  • Provide accurate, current and complete information during the registration and account opening process
  • Maintain the confidentiality of your account credentials, including User ID and password

Eligible entities include Individuals, Hindu Undivided Families (HUF), proprietary firms, partnership firms, companies, trusts and Non-Resident Indians (NRIs). Account opening is subject to verification and approval by JBS Securities.

Services Offered

JBS Securities provides the following services through its memberships on NSE, BSE, MSEI and CDSL:

  • Equity Trading: Buy and sell shares on the NSE and BSE Capital Segments
  • Derivatives (F&O): Futures and options trading on the capital markets
  • Currency Derivatives: USD-INR, EUR-INR, GBP-INR and JPY-INR pairs
  • IPO Services: Participation in initial public offerings
  • NRI Services: NSE equity trading and primary market investment access for Non-Resident Indians
  • Depository Services: Demat account services as a CDSL depository participant
  • Fixed Income: Fixed deposits, tax-free bonds, 54EC capital gain bonds, NCDs, and Gold & Index ETFs

Services are subject to applicable exchange regulations, SEBI guidelines and market conditions. JBS Securities reserves the right to modify, suspend or discontinue any service without prior notice.

Trading Rules & Obligations

By using our trading platforms, you agree to:

  • Abide by all rules, regulations and circulars issued by SEBI, stock exchanges (NSE, BSE, MSEI), clearing corporations and CDSL
  • Maintain adequate margins as required for your trading positions — pay 20% upfront margin for cash market segment transactions
  • Accept securities as margin only by way of pledge in the depository system (effective September 01, 2020)
  • Not engage in any form of market manipulation, insider trading, or fraudulent activities
  • Read and understand the Risk Disclosure Document before trading in derivatives
  • Verify your contract notes, trade confirmations and account statements regularly
  • Not keep idle funds with the stock broker — beware of fixed/guaranteed/regular return schemes

Risk Warning:As per the SEBI study (January 25, 2023, based on FY 2021-22), 9 out of 10 individual traders in the equity F&O segment incurred net losses, with an average net trading loss close to ₹50,000. Loss makers spent an additional 28% of losses as transaction costs.

Fees, Charges & Payments

The following charges may apply to your account:

  • Account Opening: ₹150 covering legal and documentation charges
  • Brokerage: As per the agreed schedule — varies by segment and plan (access charge or percentage)
  • Transaction Charges: Exchange transaction fees, STT, GST, SEBI turnover charges, stamp duty and other statutory levies as applicable
  • Demat Charges: Annual maintenance charges, transaction fees for debit/credit of securities as per CDSL tariff
  • Other Charges: Pledge/unpledge fees, physical statement charges, courier charges, delayed payment interest as applicable

Pay-out of funds and securities is credited within one business day after receipt from the exchange. As an internal practice, JBS Securities tries to effect pay-out within T+2 business days.

Fund transfers must only be made to the designated JBS Securities client bank accounts as disclosed to the stock exchanges. Do not transfer funds to any other account.

Platform Usage & Intellectual Property

Our trading platforms (desktop Exe, web and mobile) are provided for the sole purpose of accessing JBS Securities' trading services. You agree not to:

  • Copy, reproduce, distribute or create derivative works from the platform software or any content
  • Attempt to reverse engineer, decompile or disassemble any part of the platform
  • Use automated tools, bots or scripts to access the platform without authorisation
  • Share your login credentials with any unauthorised third party
  • Interfere with or disrupt the operation, security or integrity of the platform

All content, trademarks, logos, software and intellectual property on the website and trading platforms are owned by JBS Securities Pvt Ltd or its licensors and are protected by applicable intellectual property laws.

Client Obligations

As a client of JBS Securities, you are responsible for:

  • Updating your mobile number and email ID with us to receive OTPs, trade alerts, and important notifications directly from CDSL and exchanges
  • Verifying your securities, mutual funds and bonds in the consolidated account statement issued by NSDL/CDSL every month
  • Reporting any unauthorised transactions in your trading or demat account immediately
  • Ensuring that your financial details in the trading account are accurate and up to date as per exchange regulations
  • Subscribing to IPOs only by authorising your bank — no need to issue cheques; funds remain in your account until allotment
  • Keeping your KYC documents current — KYC is a one-time exercise through any SEBI registered intermediary

Prohibited Activities

You shall not use our services or platforms for:

  • Market manipulation, price rigging, circular trading, or any form of securities fraud
  • Insider trading or trading based on unpublished price sensitive information (UPSI)
  • Circulation of unauthenticated news or rumours intended to influence securities prices
  • Money laundering or financing of terrorism — we comply with the Prevention of Money Laundering Act (PMLA), 2002
  • Any activity that violates applicable laws, exchange rules or SEBI regulations
  • Misrepresentation of identity or providing false information

Violation of any prohibited activity may result in immediate suspension or termination of your account, reporting to regulatory authorities, and legal action.

Risk Disclosure & Disclaimer

Investment in securities markets is subject to market risks. Please read all related documents carefully before investing. Past performance is not indicative of future results.

  • JBS Securities does not guarantee any returns or profits on investments
  • The value of securities may fluctuate and you may receive less than your original investment
  • Trading in derivatives involves substantial risk and is not suitable for all investors
  • We do hereby declare that we are doing proprietary trading along with client business
  • Research reports and recommendations are for informational purposes only and do not constitute investment advice
  • System outages, network failures, or force majeure events may prevent execution of orders — JBS Securities shall not be liable for losses arising from such events

Account Termination & Closure

Either party may terminate the trading relationship subject to the following conditions:

  • All outstanding obligations, dues, and margin requirements must be settled before account closure
  • Account closure requests can be initiated online through SmartKYC or by submitting the closure form
  • Securities held in the demat account must be transferred or sold before closure of the demat account
  • JBS Securities reserves the right to suspend, freeze or close accounts in case of regulatory non-compliance, suspicious activity, or breach of these terms
  • Inactive or dormant accounts are subject to our Inactive/Dormant Client Policy

Upon termination, your access to trading platforms and services will be revoked. However, records will be retained as per regulatory requirements.

If your grievance is not resolved to your satisfaction, you may escalate to:

  • Exchange Investor Grievance Cells: NSE, BSE, MSEI complaint portals

All disputes shall be subject to the jurisdiction of courts in Ahmedabad, Gujarat, India. Arbitration shall be conducted as per the rules of the relevant stock exchange.

Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with:

  • The laws of India
  • Securities and Exchange Board of India Act, 1992 and SEBI Regulations
  • Securities Contracts (Regulation) Act, 1956
  • Rules, bye-laws and regulations of NSE, BSE, MSEI, and CDSL
  • Information Technology Act, 2000
  • Prevention of Money Laundering Act (PMLA), 2002
  • Any other applicable laws and regulations as amended from time to time

Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.

Modifications to Terms

JBS Securities reserves the right to amend, update or modify these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting on this page with the revised date.

Your continued use of our services after any modifications constitutes your acceptance of the updated terms. We encourage you to review this page periodically.
